晨跑团成员有一定过错

记者:7月8日,山东省临沂市一支由中老年人组成的晨跑团,出发22分钟后,在距离终点约30米的路段,遇到一辆出租车冲撞。事故导致一人死亡,两人受伤。对此次跑上机动车主路的行为,涉事运动协会的许会长说:担心与“徒步队”的活动场地产生冲突所以选择了位于兰山区的北岸,但北岸的辅路因为施工不能走,晨跑的人才跑到机动车道上。至于当地政府修建的专门健身步道,不能满足所有人的需求。

黄海波:我认为这个理由是不成立的。那个路段修路,参加健身的人可以到其他可以锻炼的场所去锻炼,为什么一定要到机动车道上锻炼呢?

张柱庭:道路交通安全法第六十一条规定:行人应当在人行道内行走,没有人行道的靠路边行走。道路交通安全法实施条例第七十六条规定:行人列队在道路上通行,每横列不得超过两人,但在已经实行交通管制的路段不受限制。事发的这条路,如果有人行道,参与健身者没有在人行道行走,这属于有过错。我们不能因为其有锻炼身体的动机而否认其违法的事实。从媒体报道看,事发地有人行道,因此晨跑团人员或者其组织者有一定的过错。

司机责任视调查结论而定

记者:临沂的这起事故发生后,涉事司机已被刑事拘留。然而,很多民众认为司机不应负全责。比如,很多民众认为,如果晨跑团不上机动车道,悲剧可能就不会发生。

张柱庭:虽然这个案件引起公众关注,形成热点问题,但我们还是应当用法眼来进行“冷”思考。首先,这个案件还在侦办当中,出租车司机是故意还是过失,需要等待查明事实后再进行判断。如果是故意,就应当按涉嫌以危险方法危害公共安全罪处理;如果是过失,则属于交通肇事案件。其次,假设是交通肇事案件的话,出租车司机构成交通肇事没有争议,因为不论晨跑团是否有过错,对司机依法定罪处罚无异议。

黄海波:晨跑团的成员在机动车道上锻炼的行为,本身就是一种交通违法行为,是事故发生的原因之一。这名司机没有尽到谨慎驾驶、安全驾驶的义务,她对事故发生也有过错,所以也要承担相应的责任。

我个人也认同一些网友的评论。不过,对于这名司机,她最后会不会被追究刑事责任,我觉得还要看交管部门最终的调查结论,然后再来看她要不要承担刑事责任。

另外,晨跑团组织者明知道这种活动可能出现危险的后果,但是还这么去实施,组织一些违法的活动,所以从责任角度来讲,组织者也有一定的责任。

晨跑组织者也应承担责任

记者:就像您刚才提到的,此次晨跑团的组织者负有一定责任,那么死者家属能否起诉晨跑团组织者,双方是否具有法律关系?按照涉事的临沂山鹰运动协会的会长介绍,这个在2009年由民间个人创立的协会属于公益性的组织,没有所谓的会费,全部都是热爱运动的民众自发加入的。

黄海波:赔偿责任是与最终的责任认定相关的。调查完成后,交警部门会出具交通事故责任认定书,其中会有明确的责任认定。

我个人认为,组织者虽然现在解释是公益组织,但是组织者毕竟把人带到了机动车道上行走,而且这个行为本身就是违法的,组织者应当要承担一定责任。我觉得,如果死者家属要找组织者索赔,组织者有可能要承担一定赔偿责任。

依据侵权责任法第三十七条规定:“群众性活动的组织者,未尽到安全保障义务,造成他人损害的,应当承担侵权责任”。如果能证明活动组织者在路线选择、安全提示等方面未尽到安全保障义务,那么组织者同样需承担相应的赔偿责任。

也就是说,因第三人的行为造成他人损害的,由第三人承担侵权责任,管理人或者组织者未尽到安全保障义务的,承担相应的补充责任。在此案中,晨跑团属于一种群众性活动,而其组织者应当对晨跑团的参加者尽到一定的安全保障义务,更不能带领他们进行危险而违法的活动。所以,对于这起事故所造成的后果,晨跑团的组织者也应当承担一定的法律责任。

张柱庭:是否起诉组织者,这是家属的权利,家属可以行使权利,也可以放弃。

健身不能以违法为前提

记者:我们调查发现,一些民间自发组织的“暴走团”“夜跑团”“晨跑团”占据机动车道锻炼的情况时有发生,交管部门也多次提醒市民要遵守交通规则,注意道路安全。

黄海波:交管部门可以制止这种行为,对这种行人交通违法行为可以进行处罚。目前,个别行人之所以敢“横行”于机动车道,我觉得只能用“任性”这两个字来概括。本来是机动车道,有些人却非要在这个地方锻炼。试想一下,在公路上锻炼能健康吗?公路是机动车最密集的地方,也是废气排放量最多的地方,在这样一个场合锻炼能有好处吗?

这样的晨跑以及相应的健身行为必须要停下来,要吸取这个教训。无论怎么讲,你做任何事情都不能以违法作为前提,你说为了健康,但健康也要守法。这个死者虽然非常不幸,我们也同情他,但是我们也可以以此为契机,要吸取一些教训,今后就别再做了,希望组织者也能够明白,吸取教训。
